1. Collection of personal data

When you submit your proposal, your personal data will be collected, processed or used for the purpose of reviewing your proposal. In this respect, the legal basis for the processing of personal data is Art. 6 (1) (b) GDPR. 

2. Name and contact details of the controller and the data protection officer

3. Transfer of personal data

Transfer of personal data to third parties: Personal data of the sender that is collected in the context of your submission may be transmitted by STIHL to third parties for the purpose of verification. The legal basis for this is the legitimate interest resulting from the fact that it is necessary to examine the submitted proposal in detail. Otherwise, personal data will only be transmitted by STIHL if and to the extent that there is a legal obligation to do so, if and to the extent that you have given your consent to do so and/or if there is a legal basis for legitimation in accordance with the relevant data protection regulations.

4. Storage of data

As a matter of principle, we store your data for as long as it is necessary to review your suggestion or as long as we have a legitimate interest in storing the data (e.g. for the possibility of contacting us at a later date in relation to your proposal). In all other cases, we will delete your personal data, with the exception of data that we are obliged to keep in order to comply with legal obligations (e.g. due to retention periods under the Tax and Commercial Code, we are obliged to keep documents such as contracts and invoices available for a certain period of time).

5. Your rights

Rights of the data subject: As a data subject of data processing, you have numerous rights at your disposal. Specifically, these are:

[1.] the right of access, i.e. You have the right to obtain information about the personal data we hold about you;

[2.] the right to rectification and erasure, i.e. At any time, you can demand the correction of incorrect data and - provided that the legal requirements are met - the completion or deletion of your data. Insofar as statutory retention obligations preclude the deletion of data, their processing will be restricted (see below);

[3.] the right to restriction of processing, i.e. Provided that the legal requirements are met, you can demand that STIHL restrict the processing of your data;

[4.] the right to object to data processing on the legal basis of "balancing of interests", i.e. You have the right to object at any time to the processing of your data by STIHL insofar as it is based on the legal basis of the "balancing of interests". STIHL will then cease processing the data, unless STIHL can prove - in accordance with the statutory requirements - compelling legitimate grounds for the further processing which outweigh your rights;

[5.] the right to withdraw consent, i.e. if you have given your consent to the processing of your data, you can revoke it at any time with effect for the future. This does not affect the lawfulness of the processing of your data until you revoke your consent;

[6.] the right to lodge a complaint with the supervisory authority, i.e. You may lodge a complaint with the relevant supervisory authority if you believe that the processing of your data violates applicable law. To this end, you can contact the data protection authority applicable to your place of residence or your country of jurisdiction or to the data protection authority responsible for STIHL (LfDI Baden-Württemberg);

[7.] the right to data portability, i.e. the right to receive the data provided in a structured, commonly used and machine-readable format and to transmit it by STIHL to another controller;

[8.] the right to receive a copy of your personal data held and processed by us. In all these cases, please contact the STIHL Data Protection Officer in writing or by e-mail – see section 2 for contact details.
